TRUCK BACK UP ACCIDENT
$100,000.00 Policy Limit Settlement for an injured San Diego worker against a third party…
Attorney Mark C. Blane represented an injured worker against an at-fault third party when that third party negligently backed their Ford F-150 onto the left leg of the worker. The third party fled the scene of the accident without exchanging insurance information. The accident occurred at a construction site and there were several co-workers who witnessed the accident. The witnesses tried to get the driver of the vehicle to not leave. Despite their efforts he fled and nobody got a license plate number. However, in the discovery file of the work comp insurance department, there was discovered a business card. This card was linked to the owner of the truck that fled the construction site scene because the at-fault party turned out to be a subcontractor to the work site.
Mr. Blane worked diligently to located the third party, and obtained his insurance information. The injuries required surgery on the knee; all medicals were covered under workers’ compensation. The policy limits of $100,000.00 were immediately extended soon after settlement negotiations began.
FINAL NOTE: The above case illustrates the importance of investigating and properly documenting a construction site accident. If this is not done properly, and expeditiously, evidence can easily disappear!
