Attorney Mark C. Blane was successful in proving breast implants had to be removed, and then replaced with newer implants, after an auto collision. The issue of causation was contested by the defense, but Mr. Blane prevailed on arguing the preponderance of medical evidence. The issue was an extremely technical one based on bio-mechanical force of the seat belts causing the injury.
The forces created by the roll-over accident caused the the implant in the breast to become inflamed and ultimately surgery was required to remove the breast. The surgery was successfully and added value to pain and suffering damages, despite the defense assertion to the contrary.
