San Diego Client Injured in Slip and Fall Due To Unsafe Construction

Mr. L, a 57-year-old resident of California, experienced a traumatic fall on April 12, 2024, when he tripped on steps that were under construction. The tape that was supposed to hold down the lip carpet area of the top step was not properly secured. In fact, the tape that was used was not even the right tape for that type of construction, and it was left in a dangerous state where it could easily catch a foot. To make matters worse, the fall occurred around a corner, making it impossible to see the hazard in advance—it was like a hidden time bomb. This fall resulted in multiple injuries, including persistent pain in his right shoulder, elbow, knee, neck, and back. In addition, he suffered from headaches, dizziness, nausea, and vision disturbances. The combination of these injuries significantly affected his daily life, making routine activities, work, and exercise increasingly difficult.

Over the course of several months, Mr. L underwent extensive medical treatment, including trigger point injections, a cervical epidural steroid injection administered by his pain management specialist, and ongoing prescription medications such as Amitriptyline and Tizanidine. Despite these interventions, he continued to experience stiffness, numbness, and significant discomfort, compounded by sleep disturbances and difficulty with focus and memory. He eventually underwent right knee surgery.

Given the complexity and severity of his injuries, our office worked diligently to gather all relevant medical records, detailed treatment histories, and physician reports. These documents were essential in establishing the full scope of his damages under California Civil Code § 3333 and related statutes governing personal injury claims, including compensation for past and future medical expenses, pain and suffering, and diminished quality of life.

Throughout this process, Mr. L faced the daily challenges of his injuries with resilience. Simple tasks, such as watching television or performing household activities, often triggered pain, dizziness, and fatigue. The combination of physical and cognitive symptoms underscored the seriousness of his claim.

By coordinating closely with his healthcare providers and leveraging the documentation of his ongoing impairments, we were able to secure a settlement that accurately reflects the impact of Mr. L’s injuries. This result ensures that he can focus on recovery and future well-being while holding responsible parties accountable for the harm he suffered.

LIABILITY

Based on the facts of the case and extensive investigation, including numerous depositions to uncover critical safety information, it was established that the hazardous condition on the steps directly caused Mr. L’s fall. I successfully argued that liability was not in dispute, demonstrating that the improperly secured tape and hidden location of the hazard created a foreseeable risk. Following this presentation of evidence, the defense agreed that liability was clear, which contributed to their decision to settle the case.
