CALIFORNIA INJURED CHILDREN | GUARDIAN AD LITEM DUTY: What specific type of duty does a Guardian Ad Litem owe a minor child in his or her California bodily injury settlement?

A:

You, if you are the Guardian Ad Litem or "GAL," retain a fiduciary duty to the minor child, and  you must maintain communication with the minor child until he or she reaches 18 years old; also, you must also make sure the minor child knows which bank or financial institution has his or her settlement funds. If you fail to do so, you could be subject to contempt of a court order, and fines and penalties.
