CHILD PEDESTRIAN INJURY: What are our rights if my child has been injured or killed by a motor vehicle when he or she was a pedestrian?

Children have the same rights as adults in all injury cases; however, their Statute of Limitation to sue does not begin until after they reach the age of majority, which in California is eighteen (18) years old.  This means, in California, there is a general two (2) year statute of limitations, and this does not begin until a child, or minor, turns eighteen years old.  Also, if a settlement is reached for a minor child, then generally the settlement will require Court approval in California.  This means there will be a Court hearing supervised by a Judge to approve the settlement for the minor child, and to issue a Court Order to deposit the settlement funds into a blocked account or investment vehicle.  This is accomplished by nominating a Guardian Ad Litem which is usually a parent or close family member.
