DEFECTIVE BICYCLE: Can a defect to a bicycle be the cause of a bike accident, and if so, who do you sue under California law?

 

A:

Yes, it can be, and you would sue the manufacturer of the defective bicycle part under California law.

Parts of the bike, like the bike frame, your helmet, or the assembly parts of the bike all of the potential to malfunction or not work properly.  If some part of the bicycle gives way, causing or contributing to the bike crash, we will have the bicycle examined by an expert rather than a bicycle shop. We need to know if there was an equipment malfunction such as brake failure, failure of the pedal to release properly, or the like.
