San Diego Trip and Fall Attorney Mark C. Blane represented a Chula Vista woman who was shopping at a store in a busy mall during the busy San Diego Holiday Season. The woman was exiting the store when her shoes got caught in a clear coat hanger that was used by store to hang its clothes causing her slide and fall causing moderate soft-tissue injury. Her injuries required physical therapy through Kaiser Permanent hospital.
Mr. Blane argued the store failed in its duty to shoppers to keep the floor clear and free of hazardous debris; the store as a business entity has a never-ending duty to look for dangers known, or for dangers it should have known about, to make the shopping experience safe. Special notice should be given to shoppers during the busy Holiday season as debris, like clear coat hangers, which are not easily seen and blend with the floor can cause injury as here. Mr. Blane was able to obtain a $22,500.00 settlement.
