San Diego Rear-end Accident & Injury Lawyer Mark C. Blane successfully represented a Pacific Beach woman (Crown Point) in a sandwich type car accident.  The woman was first rear-ended and then pushed into the car in front of her - thus "sandwiching" her between the two cars.  The following excerpt is what Mr. Blane used in his arguments to successfully navigate her bodily injury case:

"Your insured was negligent in causing an auto accident that resulted in bodily injury and property damage.  My client was at a complete stop when your insured rear-ended my client pushing him to the car in front.  The rear windows shattered on impact and the locks on the doors snapped off.  Thus, there is no question of bio-mechanical force to cause bodily injury.

My injured client presented to Sharp Memorial Hospital via ambulance where she was evaluated and given diagnostics.  She sought treatment with her primary care physician, Dr. Raymond Vance, M.D.  She then followed up with Dr. Robert Buechel, D.C. who has been providing chiropractic treatment.  In addition, she received acupuncture treatment. She underwent an MRI of the right foot and ankle which demonstrated multiple abnormalities, including findings of an abnormal signal within the medial aspecto of the tibial plafond measuring approximately 3mm.  Due to the persistent right ankle and foot pain, she saw Dr. William Shoemaker, M.D. who recommended that she be provided with a customized set of orthotics for both feet to improve the alignment and stability to the right foot and ankle and decrease swelling.  She was given conservative therapy and then released to participate in her own recovery.  Future medical care was documented in the medical findings.

Dr. Robert Buechel, D.C. 11/09/09 chart notes documents on active range of motion extension was measured at 40 degrees and was restricted due to pain, right lateral flexion was measured at 20 degrees and was restricted due to pain, left lateral flexion was measured at 30 degrees and was restricted due to pain, right rotation was measured at 45 degrees and was restricted due to pain and left rotation was measured at 45 degrees and was restricted due to pain.

Dr. Robert Buechel, D.C. 04/16/2010 chart notes documents occasional neck stiffness. Dr. Robert Buechel, D.C. 04/16/2010 chart notes documents on active range of motion testing in the cervical region, right lateral flexion was measured at 25 degrees and was restricted due to pain, left lateral flexion was measured at 35 degrees, right rotation was measured at 65 degrees and was restricted due to pain and left rotation was measured at 65 degrees and was restricted due to pain.

To this end, Mr. Blane was able to resolve the claim and obtain a favorable net recovery for his injured client.
