It is certainly good news to hear about Representative Gabrielle Gifford, the Democratic representative from Tucson, Arizona who was shot in the head on January 8, 2011 at a political rally. She is slowly regaining her ability to speak and recently asked for a "piece of toast." Right now, no medical doctor is sure if she will ever regain her speech back 100%; including all cognitive functions.

This is due to the horrible massacre last week that left Arizona Congresswoman Gabby Giffords seriously injured with a traumatic brain injury from a gunshot.
About two years ago, four women, Qi Zhao and her two sisters, and one niece, were all riding the Disney Tram at Disneyland when their tram took took at turn around to go in a reverse direction. Ms. Zhao had been at the theme park about 10 hours and was fast asleep when the tram took the turn around and fell causing a brain injury.
This injury also caused a fractured skull and she was in a come for about three weeks; fortunately, the other sisters, and niece suffered only minor injuries. A lawsuit was filed by the family based on safety violations with Tram. More specifically, the Tram lawsuit alleged violations in safety precautions for tourists who get tired on the Tram ride. Now, Disney asserted that there is an assumption of the risk when a person does not listen to the safety precautions that they continually announce during the Tram ride. This case was going to a jury but Disney decided to settle it out of Court. Disney, of course, did not list publicly (as they usually do) the settlement amount, but the case was going before a conservative Orange County jury.
I suspect both sides had some interesting points in liability and defense. What do you think? Should Disney pay for these injuries when a person falls asleep in the Tram? Let me know your thoughts. Doctors in Florida will be looking at whether famous pitchman Bill Mays recent passing was caused by Mild Traumatic Brain Injury also known as MTBI. On June 27, 2009, Mays was aboard US Airways Flight 1241 when the front tire of the aircraft blew out during a landing at Tampa International Airport. Mays reported to a TV crew after the landing that he was hit on the head by falling debris (suit case) from an overhead compartment.
Everyone should be aware that an injury to the head can cause a type of bleeding that may cause serious injury, and in some cases, even death. Sometimes a person loses consciousness for a short time, and or may become “dazed and confused” following the head injury. However, there is a time that passes known to doctors as the “lucid interval” and the injured person appears to be fine.
Doctors call this period of the lucid interval as the time that passes after a traumatic brain injury; remember, a traumatic brain injury can be rather mild or severe; after this interval period the person with the head injury starts to deteriorate rapidly. This period of lucidness can last minutes or even hours. As blood slowly or rapidly collects in the brain/head region due to the injury to the brain, it slowly gives way to over powering the body to compensate. This blood collection causes a rise in intracranial blood pressure, which can and does damage brain tissue.
However, for now, Dr. Vernard Adams, after performing an initial autopsy on Mays’ body on June 29, 2009, has confirmed that Mays suffered from hypertensive heart disease, and that a heart attack was the likely cause of his death. To this end, this cannot be conclusive until toxicology tests and tissue test are completed.
It is vitally important to be ever diligent in being checked out immediately by a health care professional if you are someone you know has suffered a head injury no matter how minute.

The courts are holding falling merchandise cases very favorably to injured folks at the moment; the reason I feel this is the case, is that the courts want to send a message to merchants to make their stores and shops SAFE for the public. When you are injured by an item that falls on you, the injuries can be devastating. Most injuries obviously involve the head/skull/brain and neck (spine).
More than likely, the reason the item or piece of merchandise fell in the first place was because of some breach of standard of due care in either the shelving, or the placing of the item on the shelf, etc.
The sad truth is head traumas are extremely common with children; according to one statistic, they account for approximately 100,000 hospitalizations (overnight stays at a hospital) each year in the United States. The San Diego area is a huge metropolis and it too is affected by many San Diego brain injuries. San Diego is also a very active family location; a lot of children enjoy the outdoors in this area of the United States. Different mechanics are involved with children and head injuries; you can find children falling off of bicycles, just everyday falls, head injuries in sports, car accidents and even child abuse.
It is more difficult to measure or document the loss functionality of the brain in a child. Why is this so?
In adults, there are usually prior medical records, prior medical history, job histories, and more adult witnesses who know the adult that can testify as to the behavior change they see. I sometimes call this the HIDDEN DAMAGES in a brain injury legal case. Earlier in our medical history, doctors and medical experts assumed that children in general were more resistant to a brain injury or head trauma in comparison with adults due to the fact that they were growing. Medical evidence as to this appears to still be on the fence, and even some medical research suggests that children are more prone to brain trauma in comparison to adults with even the same force or trauma.
A COUP Injury occurs at the precise site of impact to the head (brain goes into skull at site of trauma), and a CONTRECOUP Injury occurs on the side of the head that was opposite of the site of impact (brain goes into opposite side of skull from site of trauma). Thus, the brain is hitting against the skull bone twice, not once.
When this occurs in children, sometimes the neurologic deficits after a head trauma may not manifest for many years after the initial head trauma. Why? For one reason, frontal lobe functionality in children develop later in a child’s growth. Thus, the brain injury may not become apparent until the child reaches a later age such as adolescence which is precisely in line with the develop of higher level develop with the ability to reason.
The Frontal Lobe Section of our brains control our interpersonal skills, social interactions; any type of injury to a child’s brain may not manifest itself until much later (see my prior blog at http://www.blanelaw/blog under Brain Injuries). At the same time, injuries to a child’s brain may not impair the writing and reading centers of the brain until much later in child development. Another medical fact that may contribute to a child’s head injury becoming more difficult to treat or stabilize is the fact that a child’s skull is only approximately 1/8 as durable as that of a normal adult skull. This alone can show why brain injuries in children are more common in forces of trauma.

Any Trauma to the head/brain can impair or disrupt Brain Function. Here are some symptoms I have found in my La Jolla Injury Law Practice with regards to Head Trauma in general:
